How the AARTO Demerit Points System Works in South Africa

The Administrative Adjudication of Road Traffic Offences (AARTO) Act is fundamentally changing how traffic violations are handled across the country. If you drive on South African roads, understanding the new AARTO demerit points system is critical to protecting your driving licence and your livelihood. While traditional fines only hit your wallet, the AARTO framework introduces a strict points-based penalty system where repeat offences can lead to severe legal consequences, including the permanent cancellation of your driver's licence.

The AARTO Lifecycle: From Infringement to Enforcement

Unlike the older Criminal Procedure Act (CPA) still used in municipalities like Cape Town, AARTO operates on a structured, multi-step administrative process. When you commit a traffic offence in an AARTO-active zone, the following stages apply:

    • Infringement Notice: This is the initial fine issued via a camera or a traffic officer. If you pay within the first 32 days, you receive a 50% discount on the monetary fine. However, the associated demerit points will still be permanently added to your driving profile.

    • Courtesy Letter: If you ignore the initial 32-day window, the Road Traffic Infringement Agency (RTIA) issues a courtesy letter. This revokes your 50% discount and adds an automatic R100 administrative penalty fee to your outstanding balance.

    • Enforcement Order: If another 32 days pass without payment or a formal dispute, an enforcement order is issued. This adds another R100 fee and instantly places an administrative block on your eNaTIS profile. This block prevents you from renewing your vehicle licence disc, registering new vehicles, or renewing your driving licence card until the debt is settled in full.

How the Demerit Points System Affects Drivers

Every licenced driver in South Africa starts with a clean slate of zero demerit points. When you commit an offence, the RTIA allocates points based on the severity of the transgression.

    • The 15-Point Threshold: Your driving licence remains active as long as you stay under 15 points. Once you exceed 15 points, your licence is officially suspended.

    • Suspension Periods: Your driving privileges are suspended for three months for every single point accumulated over the 15-point limit. During this suspension period, driving a vehicle is classified as a criminal offence.

    • Permanent Cancellation: If your licence is suspended for a third time, the RTIA will permanently cancel and destroy your driver's licence. To legally drive again, you must wait out the ban and completely retake both your learner’s and driver’s licence tests from scratch.

    Reducing Your Demerit Points

The system does reward safe driving behaviour over time. Motorists can reduce their demerit points through two primary methods:

    • Clean Driving: One demerit point automatically expires for every three consecutive months you drive without committing a new traffic infringement.

    • Rehabilitation Programmes: The government offers approved driver rehabilitation courses. Completing this programme successfully allows you to shave four points off your total balance, though this option is limited to once per year.

    Frequently Asked Questions About AARTO

When does the AARTO demerit point system start? Phase 2 of the AARTO fines rollout began in 62 municipalities on 1 July 2026. The final Phase 4, which activates the live counting of demerit points against driver profiles, is scheduled to follow during the nationwide rollout spanning 2026 and 2027.

Can I dispute an AARTO infringement? Yes. If you believe a fine was issued incorrectly (e.g., your vehicle was cloned), you must submit an AARTO representation form to the RTIA within the initial 32-day window. Do not pay the fine if you plan to dispute it, as payment is legally considered an admission of guilt.

Do camera speeding fines carry demerit points? Yes. Under AARTO, both roadside officer stops and automated camera violations will carry corresponding demerit points attached to the registered owner of the vehicle, unless the owner formally nominates another driver.
